What Is a Declaration of Identity?
A Declaration of Identity is very similar to a Certificate of Identity and is often used in the same way during a property transaction. The key difference is that it is formally sworn and witnessed by a Commissioner for Oaths, which may be required by your solicitor in certain situations.
If you are in the middle of buying or selling a property and questions come up about boundaries, your solicitor may request this document. It allows them to clearly deal with matters such as:
- Boundary lines and maps
- Encroachments
- Easements (such as rights of way)
- Over-sailing or building overlaps
Having this confirmed helps avoid delays and ensures the conveyancing process can move forward with confidence.
In straightforward terms, it provides a clear, formal record of what is on the ground and what is contained within your title documents, just with the added step of being legally sworn.
If you’re unsure whether a Declaration of Identity is required, your solicitor will be able to advise you based on your specific transaction.
