Terms and Conditions for Structural Calculations Service

It is essential that the limitations and terms of service are understood and agreed before engaging our services. Booking or use of our services presumes your agreement to these terms.

1. Structural Calculations Service Overview

The principal objective of this service is to provide structural design and calculations for specific elements of a property, based on information supplied by the Client and/or their appointed representatives.

This is a remote service, and designs are prepared without site inspection unless otherwise agreed in writing.

The service includes items such as:

  • Steel beam design for load-bearing wall removal
  • Structural openings
  • Roof support structures
  • Structural input for new residential properties based on Architect’s drawings

All services are carried out by or on behalf of Property Health Check Ltd. and are covered by Professional Indemnity Insurance.

2. Scope – What the Service Includes

2a) General

  1. Preparation of structural calculations based on information provided.
  2. Design of specific structural elements as requested by the Client.
  3. Issuance of structural drawings and/or calculations in PDF and/or CAD format where agreed.
  4. The service is provided remotely unless otherwise agreed in writing.

2b) New Residential Dwellings (Architect-Led Projects)

  1. Structural design is based on Architect-issued drawings and information.
  2. Coordination of layout, planning compliance, and architectural design remains the responsibility of the Architect.
  3. Any changes to architectural drawings must be referred for structural review and may incur additional fees.

3. Client Obligations

  1. Clients must understand and accept these terms and conditions prior to engaging the service.
  2. Clients are responsible for ensuring all information provided (drawings, dimensions, photographs, descriptions) is accurate and complete.
  3. Clients must consult with their designer, architect, building contractors before submitting measurements/details, unless suitably qualified.
  4. Clients must notify Property Health Check Ltd. (PHC), in writing, of any changes to design, scope, or site conditions. Any change to be confirmed in writing by PHC.
  5. Clients must ensure that contractors verify all dimensions and conditions on site prior to construction.

4. Limitations of Service

4a) General

  1. This service does not include a structural survey or inspection of the property.
  2. No site visits are included unless agreed in writing.
  3. Designs are limited strictly to the elements requested.
  4. Temporary works, sequencing, and construction methodology are excluded unless agreed separately.
  5. Any structural/planning drawings provided as part of this service do not include architectural details or finishes.

4b) Information Accuracy and Reliance

  1. All designs are based solely on information provided by others.
  2. No independent verification of site conditions is undertaken.
  3. Property Health Check Ltd. accepts no liability for errors arising from inaccurate, incomplete, or misleading information.

4c) Site Conditions and Accessibility

  1. No responsibility is accepted for hidden, concealed, or unknown conditions.
  2. Variations between drawings and actual site conditions are outside the scope of this service.
  3. Foundation conditions and material defects are excluded.

4d) Construction and Workmanship

i) The contractor is responsible for:

  • Verifying dimensions on site
  • Ensuring safe construction methods
  • Building in accordance with the design

ii) Property Health Check Ltd. accepts no responsibility for:

  • Workmanship
  • Materials used
  • Construction execution

4e) Regulatory & Statutory Matters (Ireland)

  1. Structural elements are designed in accordance with applicable Irish Building Regulations.
  2. The following are excluded unless specifically agreed:
    • BCAR documentation
    • Certificates of Compliance
    • Assigned Certifier role
  3. Property Health Check Ltd. is not appointed as:
    • Project Supervisor Design Process (PSDP)
    • Project Supervisor Construction Stage (PSCS)
  4. Health & Safety Authority (HSA) notifications are excluded.

4f) Third-Party Design

  1. Specialist or proprietary elements (e.g. trusses, prefabricated systems) are to be designed by others.
  2. No responsibility is accepted for third-party design.

5. Liability and Indemnification

  1. Liability is limited to losses arising directly from negligence within the agreed scope of works.
  2. Total liability is strictly limited to the fee paid for the service.
  3. No liability is accepted for:
    • Indirect or consequential loss
    • Loss of profit or use
    • Delay-related costs
    • Third-party claims
  4. No liability is accepted for:
    • Errors in provided information
    • Failure to verify site conditions
    • Construction methods or workmanship
  5. Any variation between assumed and actual site conditions invalidates the design unless reviewed and confirmed in writing.
  6. All services are covered under Professional Indemnity Insurance, and no greater liability is assumed than that covered under such insurance.

6. Design Changes and Variations

  1. Changes to the design brief, architectural drawings, or site conditions may require revised calculations and additional fees.
  2. Designs must not be used if changes occur without written confirmation.

7. Price and Payment

  1. Quotations are provided in writing and valid for 30 days.
  2. Payment is required prior to issue of final deliverables unless otherwise agreed.
  3. Payment methods include credit/debit card and electronic transfer.

8. Deliverables

  1. Structural calculations
  2. Structural drawings (PDF and/or CAD format where agreed)
  3. Deliverables are issued electronically unless otherwise agreed.

9. Data Protection

We adhere to GDPR and all relevant data protection legislation. Client data will be used solely for the purpose of delivering the service and will not be shared without consent unless required by law.

10. Consumer Rights

Clients retain all statutory rights under applicable consumer protection legislation.

11. Confidentiality and Ownership

  1. Ownership of documents transfers upon full payment.
  2. Documents are for use on the specified project only.
  3. Documents may not be reused or transferred without written consent.
  4. No third-party reliance is permitted without prior written agreement.

12. Complaints Policy

  1. Clients should contact Property Health Check Ltd. directly in the event of a complaint.
  2. Complaints can be made via email, telephone, or written correspondence.

13. Acceptance of Terms

Use of the service and/or design documents constitutes acceptance of these terms and conditions.

15. Termination

  1. The Client may terminate the agreement with written notice.
  2. Work completed up to the date of termination will be chargeable.
