It is essential that the limitations and terms of service are understood and agreed before engaging our services. Booking our services presumes your agreement to these terms.

Overview of Planning Services

Property Health Check Ltd. offers professional assistance in preparing drawings and submitting Planning Applications to the relevant local authority. The planning services are offered in a staged approach as follows:

  • Planning Drawings
  • Planning Application Submission

These services may relate to Outline, Full or Retention planning.

Scope of Services

Planning drawings form a key part of a planning application submission. Our planning services start with providing planning drawings. Once drawings have been finalised, a planning application may be required. The finalised planning drawings may then be used as part of the planning application submission. The scope of the 2 services is outlined below.

Planning Drawings Service

The Planning Drawings Service is for residential, single-use properties only and includes:

  • Site Visit
  • Preparation of relevant planning drawings (note that these are not construction drawings) and site layouts based on the information provided or gathered.
  • Liaison with the client throughout the process to confirm details and finalise drawings.
  • Up to 2 revisions of the drawings are included in the service. Further revisions will incur an additional hourly fee. 
  • Final agreed drawings will be issued to the client.

Planning Application Submission

The Planning Application Submission Service is for residential, single-use properties only and includes:

  • Final confirmation with client of the planning drawings to be submitted with the planning permission application.
  • Agent form, signed by client, to be completed to authorize Property Health Check Ltd. to represent the client.
  • Preparation and completion of the relevant local authority planning application forms.
  • Publish the Newspaper advertisement as required by the Local Authority
  • Purchase digital OSI Planning Pack as required by the Local Authority
  • Site notice(s), with instructions, provided to the client for display
  • Submission of the final application to the Local Authority on behalf of the client, where instructed.
  • Amendments are not possible after the application has been submitted to the Local Authority.
  • Where additional information is requested by the Local Planning Authority (e.g. re drainage pipes, water services or CCTV cameras) to support the planning application, additional charges may apply

Client Obligations

  • Clients must read, understand, and accept these terms and conditions before booking.
  • Clients are responsible for securing any necessary property access or permissions prior to the site visit.
  • Clients are responsible for erecting the site notice(s), as provided by Property Health Check Ltd. and for ensuring the notice(s) are maintained in place in line with planning regulations.
  • Clients must review and confirm all drawings and documentation before submission.
  • Clients are encouraged to consult with their architect or legal advisor to understand the full implications of a planning decision.

Limitations of Service

  • Commercial and multi-unit properties are excluded from this service.
  • The service does not include design advice, engineering calculations, or structural assessments unless explicitly agreed in writing. An additional fee is chargeable for these services. 
  • Drawings provided as part of the Online Service are based on client-supplied data and are not intended for legal or construction purposes. The drawings are for planning purposes only.
  • Opinions expressed in the drawings or documents are based on information provided by the client and/or visually observed by the engineer at the time of inspection.
  • Property Health Check Ltd. does not guarantee that any planning application will be granted by the Local Authority.
  • Site notice(s) to be erected and maintained in place by the client.
  • Matters of title, boundary ownership, private rights, or easements are outside the scope of this service.
  • We do not represent clients at planning appeals or enforcement proceedings unless separately contracted.
  • If the Local Authority requests additional information as part of the planning application, additional fees will be chargeable and will be based on the requirements of the Local Authority. 

Price and Payment

Valid numbered quotations are provided in writing for the specific service and are valid for thirty (30) days from the date of issue. Prices include VAT at the prevailing rate. Payment is taken at the time of booking via credit/debit card or Electronic Funds Transfer (EFT). Additional fees may apply for resubmissions, amendments, or revised drawings requested after the initial submission.

Planning application fees include third-party fees such as, the local planning authority, Newspaper Advertising and Ordnance Survey Map(s) and are additional to the fees charged by Property Health Check Ltd. for the planning application submission service.

Additional extra work required for the planning application or client changes beyond the scope of the service will be subject to additional fees.

Issue of Planning Drawings

The final planning drawings will be issued by email to the email address advised by the client at the time of booking. The email will contain a link to a secure site, where the report can be viewed and downloaded.

The drawings are provided in PDF format only.

Requests to provide a hard copy may incur an additional postage fee, and the drawings will be issued in black and white.

Planning Application Submission

Planning applications will be submitted in accordance with local planning authority regulations and processes pertaining at the time. Clients will be able to track the status of the planning application online at the relevant planning authority website.

Data Protection

We adhere to GDPR and other relevant data protection laws. Personal data collected will be used solely for the purpose of the planning application and will not be shared without client consent, except as required by law. Data will be stored securely and disposed of responsibly when no longer required.

Consumer Rights

Clients retain all statutory rights under Irish consumer protection law and the Consumer Rights Act 2022. Clients are encouraged to review these rights before booking.

Liability, Confidentiality, and Ownership

Liability is limited to a maximum amount equal to the fee paid for the service. Ownership of all documents and reports passes to the client upon receipt of full payment.

Neither Property Health Check Ltd. nor the Engineer shall have any liability to the Client for any loss, damage, costs, expenses or other claims for compensation arising from any input material or Instructions supplied by the Client which are incomplete, incorrect, inaccurate, illegible, out of sequence or in the wrong form, or arising from their late arrival or non-arrival, or any other fault of the Client.

All documentation is issued to the person named on the booking for their use and that of their legal or planning representative. No third-party use is authorised without written consent from Property Health Check Ltd.

Acceptance of Terms

By booking and paying for this service, clients acknowledge and agree to be bound by these terms and conditions.

Termination

The client may terminate the agreement with a minimum of two working days’ notice prior to the scheduled site visit. If cancelled within 2 working days, 25% of the quotation fee will be charged.
In the case of the online-only service, work may begin immediately after payment. No refund applies once work has commenced.
Third party fees incurred will not be refunded.
